 AGREEMENT OF SALE OF PET PUPPIES 

 The above indicated Coton de Tulear puppy, to be named Cotonwind's                                                                                     is sold to the person(s) listed above as purchaser(s) on this            day of                               , 200__ for the sum of                                         .  At the time of sale this puppy is a healthy, happy puppy of sound temperament.  S/he is the result of selective mating of parents with and is an excellent representative of the breed.  All COTONWIND puppies are sold on a complete health and satisfaction guarantee.  Your puppy has had a complete and thorough examination by our Veterinarian and is guaranteed to be in a good, clean state of health on departure from our kennel.  You are advised to have your Veterinarian examine your new puppy within 72 hours of departure from our kennel.  If for any reason the purchaser is not satisfied with the puppy within the 72 hour period, s/he may return it to our kennel at his/her expense, provided the puppy is in the same condition as when sold.  The purchaser will receive a replacement puppy from the next available litter or a full refund as decided upon by the breeder.  All veterinary costs after departure from our kennel, no matter what the reason, and including the 72-hour period, are the responsibility of the buyer. 

COTONWIND KENNELS PROVIDES THE FOLLOWING GUARANTEE on each pet prospect puppy sold:

                 Free of proven hereditary conditions that hinder a normal life for a period of two years.  This determination must be made by a recognized institution
                 licensed to make such determinations.

 COTONWIND REG’D KENNELS DOES NOT GUARANTEE THE FOLLOWING on any puppy sold:

  Behavioural problems or personality traits not associated with temperament, and any conditions not set out herein.

If your puppy is unable to live a normal life as a result of any of the guaranteed conditions and if contract conditions have been adhered to and suitable evidence is produced, the puppy may be returned to the breeder in good clean condition at the buyer's expense with the Registration papers signed over to the breeder.  A puppy of the same sex and quality, selected by the breeder, will be guaranteed to the buyer from another litter, though not necessarily from the same bitch nor from the next litter due to arrive.  The breeder reserves the right to refund the purchaser his original price of the puppy should the breeder decide not to place another puppy with the purchaser.  Alternatively, where the purchaser chooses to keep the said dog, the breeder shall, at the option of the breeder, and upon proof of spay/neuter, reimburse the purchaser an amount determined by the breeder in line with the condition and its effects on the dog's life.  In any case, this amount shall not exceed, in total and in combination for all conditions, a lifetime maximum of one half the purchase price of the puppy.  The breeder may request that the purchaser obtain further opinions in the case of x-rays, eye and/or heart examinations.  Obtaining additional opinions will be the responsibility of the purchaser.  The breeder may request to have any reports or x-rays mailed or shipped to the breeder's veterinarian.  Under no circumstances will COTONWIND REG'D KENNELS be responsible for the cost of any veterinarian bills for any reason whatsoever, nor will COTONWIND REG'D be held responsible for the cost of surgery for any reason whatsoever.   

             1.             The buyer will take good care of the dog, providing quality nutrition, shelter and medical care, including annual vaccinations so as to ensure
             the physical and emotional wellbeing of the dog.

2.             The buyer agrees to feed breeder recommended puppy food and at the appropriate age (as advised by your vet) to switch the puppy to a food recommended by the breeder or in special circumstances, a food recommended by your veterinarian.  The buyer agrees to keep the dog at a suitable weight.

3.             The buyer agrees to provide daily exercise and to neither overwork nor underwork the dog, and will not allow the dog to run at large unsupervised.  The buyer further agrees to not tie the dog to any fixed object.

4.             The buyer undertakes to ensure the puppy receives obedience training, preferably through a recognized training school.

5.             The buyer agrees the dog shall never be used for experimental or research purposes.

6.             The buyer agrees that dog shall be kept well groomed.

7.             The buyer agrees to contact the breeder should the buyer need to part with this dog for whatever reason.  The breeder reserves the right to first refusal.

8.             The buyer agrees to contact the breeder at all times when the dog has been seen by a Veterinarian for any condition other than routine reasons.

 PUPPIES WHICH HAVE BEEN REARED CONTRARY TO ANY OF THE AFOREMENTIONED CONDITIONS WILL BE MORE SUSCEPTIBLE TO HEALTH PROBLEMS, UNSOUNDNESS, LACK OF CLEARANCES, OR PERHAPS BE OF POORER QUALITY THAN IT HAD THE POTENTIAL AS A PUPPY TO BE, AND AS SUCH, CONTRAVENTION OF THE ABOVE EIGHT CONDITIONS WILL RENDER THE GUARANTEE NULL AND VOID.

 Puppies sold on an Agreement of Sale of Pet Puppies shall be spayed/neutered by the Purchasers before the dog attains nine (9) months of age.  Puppies leaving Cotonwind Kennel do so on a Non-Breeding Agreement.  This Agreement of Sale forms the Non-Breeding agreement and the purchaser is bound by the Non-Breeding clauses of this contract, wherein the buyer agrees not to use this dog for breeding pending meeting the conditions as set out herein.  The Non-Breeding Agreement inherent in this Agreement of Sale will not be removed.

 
In the event that the dog I is used for breeding which is sold as a pet, or where written permission of
Cotonwind Reg’d has not been given to breed the said dog, a $10,000.00 fee shall be levied and this fee
shall be binding upon the said purchaser.

 It is understood and agreed to by the parties to this agreement that this agreement and the purchase and sale of the said dog shall fall under the jurisdiction of the laws of the City of Kawartha Lakes, Province of Ontario and that any matters with respect to this Agreement shall be dealt with as per the laws governing this location.  It is further understood that any circumstances/ situations/disputes arising which are not covered within this Agreement shall be remedied at the discretion of the breeder and the breeder's decision shall be final and binding.

By signing this Agreement of Sale, the buyer acknowledges having read this Agreement in its entirety and agrees to all terms and conditions within this agreement.  This agreement is signed this ______ day of  _____________, 200____.
